The international law expert, Mark Ellis, has said that the judgment against the four former leaders of the Kosovo Liberation Army is expected to face a strong appeal process. Ellis has estimated that the judgment can be contested both in terms of fact and law. In an interview for Radio Free Europe, he explained what could be the subject of complaints from the defense and the prosecution. "I think that in an appeal there is always the possibility to argue that the judgment is wrong, either in fact or in law. That's what the defense will try to do. However, it should be remembered that the Prosecutor's Office can also appeal. As for acquittals of crimes against humanity, I expect the Prosecution to argue that the trial panel incorrectly applied the criterion for the existence of a widespread or systematic attack," he said. Ellis also explained what will be the main arguments that the defense can use in the appeal process. "On the other hand, I think that the defense will argue that there was no evidence that directly linked Thaci to concrete crimes, or that proved that he had effective control over the commanders. This was one of the arguments of the defense. So, they will argue that the facts do not support the verdict. I think that we will have a strong appeal process, from both sides", he said. The international law expert estimated that the appeal process may take longer due to the complexity and volume of the case. "It is a good question. Given how long the trial has taken, the appeal may also take time. But this is not a new trial \u2013 the case will not be retried from the beginning. In the appeal, the legal issues and the facts that were presented during the trial will be examined.
