tehdi\u0307di\u0307 ve her t\u00fcrl\u00fc g\u00fcvenli\u0307k ri\u0307ski\u0307ne kar\u015f\u0131 uluslararas\u0131 hukuk \u00e7er\u00e7evesi\u0307nde gerekli\u0307 her t\u00fcrl\u00fc tedbi\u0307ri\u0307 almak, Irak ve Suri\u0307ye&#8217;deki\u0307 t\u00fcm ter\u00f6ri\u0307st \u00f6rg\u00fctlerden T\u00fcrkiye&#8217;ye y\u00f6nelebi\u0307lecek sald\u0131r\u0131lar\u0131 bertaraf etmek ve ki\u0307tlesel g\u00f6\u00e7 gi\u0307bi\u0307 di\u0307\u011fer muhtemel ri\u0307sklere kar\u015f\u0131 ulusal g\u00fcvenli\u0307\u011fi\u0307n i\u0307dame \u015feki\u0307lde, gerekti\u0307\u011fi\u0307nde T\u00fcrk Si\u0307lahl\u0131 Kuvvetleri\u0307ni\u0307n (TSK) yabanc\u0131 \u00fclkelere g\u00f6nderi\u0307lmesi\u0307, yabanc\u0131 si\u0307lahl\u0131 kuvvetleri\u0307n T\u00fcrki\u0307ye&#8217;de bulunmas\u0131 ve bu kuvvetleri\u0307n h\u00fck\u00fcmeti\u0307n beli\u0307rleyece\u011fi\u0307 esaslara g\u00f6re kullan\u0131lmas\u0131 i\u0307le h\u00fck\u00fcmet taraf\u0131ndan beli\u0307rlenecek esaslara g\u00f6re gerekli\u0307 d\u00fczenlemeleri\u0307n yap\u0131lmas\u0131 i\u0307\u00e7i\u0307n TBMM&#8217;nin karar\u0131yla h\u00fck\u00fcmete veri\u0307len bi\u0307r y\u0131ll\u0131k i\u0307znin 2 Ekim 2015&#8217;ten i\u0307ti\u0307baren bi\u0307r y\u0131l daha uzat\u0131lmas\u0131na dai\u0307r karar, ge\u00e7en y\u0131l 8 Eyl\u00fcl&#8217;de Resmi Gazete&#8217;de yay\u0131mlanm\u0131\u015ft\u0131.<\/p>\n<p>T\u00fcrkiye&#8217;nin g\u00fcney kara s\u0131n\u0131rlar\u0131 boyunca ulusal g\u00fcvenli\u011fe d\u00f6n\u00fck risk ve tehditlerin artt\u0131\u011f\u0131, Irak&#8217;\u0131n kuzeyinde silahl\u0131 ter\u00f6r \u00f6rg\u00fct\u00fc PKK unsurlar\u0131n\u0131n varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrd\u00fc\u011f\u00fc belirtilen kararda, Suriye ve Irak\u2019ta di\u011fer ter\u00f6r unsurlar\u0131n\u0131n say\u0131s\u0131 ve ortaya koyduklar\u0131 tehditte de \u00f6nemli art\u0131\u015f g\u00f6zlendi\u011fi bildirilmi\u015fti.<\/p>\n<p>T\u00fcrkiye&#8217;nin, Irak&#8217;\u0131n toprak b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fcn, milli birli\u011fi ve istikrar\u0131n\u0131n korunmas\u0131na b\u00fcy\u00fck \u00f6nem atfetti\u011fi vurgulanan kararda, ter\u00f6r gruplar\u0131n\u0131n Irak\u2019taki mevcudiyetine ve bunun do\u011furdu\u011fu tehditlere kar\u015f\u0131 askeri, siyasi ve diplomatik tedbir ve giri\u015fimlerin art\u0131rarak s\u00fcrd\u00fcr\u00fclmesinin \u00f6nemine de\u011finilmi\u015fti.<\/p>\n<p>Suriye&#8217;de ise rejimin \u015fiddet politikalar\u0131n\u0131n, ter\u00f6r gruplar\u0131na deste\u011finin ve halk\u0131n\u0131n etnik ve mezhepsel farkl\u0131l\u0131klar\u0131n\u0131 fiili \u00e7at\u0131\u015fmaya d\u00f6n\u00fc\u015ft\u00fcrme siyasetinin insani durum, b\u00f6lgesel ve uluslararas\u0131 g\u00fcvenlik ve istikrar bak\u0131m\u0131ndan yol a\u00e7t\u0131\u011f\u0131 risk ve tehditlerin devam etti\u011fi aktar\u0131lan kararda, &#8220;Bu \u00e7er\u00e7evede, ilk olarak 2007 y\u0131l\u0131nda kabul edilen ve 6 defa uzat\u0131lan Irak tezkeresi ile 2012 y\u0131l\u0131nda kabul edilen ve bir defa uzat\u0131lan Suriye tezkeresinin 2014 y\u0131l\u0131nda tek metin halinde kabul\u00fcn\u00fc zaruri hale getiren ve ulusal g\u00fcvenli\u011fimizi tehlikeye atabilecek her t\u00fcrl\u00fc risk, tehdit ve eyleme kar\u015f\u0131, uluslararas\u0131 hukuktan kaynaklanan haklar\u0131m\u0131z do\u011frultusunda gerekli \u00f6nlemlerin ulusal d\u00fczeyde tespit edilerek hayata ge\u00e7irilmeye devam olunmas\u0131, bunun yan\u0131 s\u0131ra DEA\u015e ve benzeri ter\u00f6r \u00f6rg\u00fctleriyle m\u00fccadele amac\u0131yla olu\u015fturulan uluslararas\u0131 koalisyon b\u00fcnyesinde y\u0131ll\u0131k izin s\u00fcresinin, ayn\u0131 kararda belirlenen ilke ve esaslar dahilinde, 2 Ekim 2015 tarihinden itibaren bir y\u0131l uzat\u0131lmas\u0131, Anayasa&#8217;n\u0131n 92\u2019nci maddesi uyar\u0131nca Genel Kurulun 3 Eyl\u00fcl 2015 tarihli 9. birle\u015fiminde kabul edilmi\u015ftir.&#8221;<\/p>\n<p>BMGK&#8217;n\u0131n Irak ve Suriye&#8217;ye y\u00f6nelik karar\u0131<br \/>\nDAE\u015e ile m\u00fccadeleye y\u00f6nelik Birle\u015fmi\u015f Milletlerce al\u0131nan karar da T\u00fcrkiye&#8217;nin s\u0131n\u0131r \u00f6tesi operasyondaki hakl\u0131l\u0131\u011f\u0131n\u0131 ortaya koyuyor.<\/p>\n<p>Birle\u015fmi\u015f Milletler G\u00fcvenlik Konseyinin (BMGK) ilgili karar\u0131yla DAE\u015e ve onun \u015fiddet i\u00e7eren a\u015f\u0131r\u0131l\u0131k\u00e7\u0131 ideolojisi, ter\u00f6r eylemleri, yo\u011fun, sistematik ve yayg\u0131n insan haklar\u0131 ihlalleri ve uluslararas\u0131 insani hukuka y\u00f6nelik i\u015fledi\u011fi su\u00e7lar \u015fiddetli \u015fekilde k\u0131nand\u0131.<\/p>\n<p>Sivillerin ay\u0131rt edilmeksizin \u00f6ld\u00fcr\u00fclmesi ve kasten hedef al\u0131nmas\u0131, say\u0131s\u0131z mezalim, kitlesel infaz ve askerleri de kapsayacak \u015fekilde hukuk d\u0131\u015f\u0131 \u00f6ld\u00fcrmeler, dini temelleri veya inanc\u0131 nedeniyle bireylere ve t\u00fcm topluma y\u00f6nelik i\u015fkenceler, sivillerin ka\u00e7\u0131r\u0131lmas\u0131n\u0131, az\u0131nl\u0131k grup \u00fcyelerinin zorla yerinden \u00e7\u0131kar\u0131lmas\u0131, \u00e7ocuklar\u0131n \u00f6ld\u00fcr\u00fclmesi ve sakat b\u0131rak\u0131lmas\u0131, \u00e7ocuklar\u0131n askere al\u0131nmas\u0131 ve kullan\u0131lmas\u0131, tecav\u00fcz veya farkl\u0131 \u015fekillerde cinsel \u015fiddet, keyfi tutuklamalar, okullara ve hastanelere y\u00f6nelik sald\u0131r\u0131lar, k\u00fclt\u00fcrel ve dini yap\u0131lar\u0131n tahrip edilmesi, ekonomik, sosyal ve k\u00fclt\u00fcrel haklar\u0131n kullan\u0131m\u0131 ile e\u011fitim haklar\u0131n\u0131n kullan\u0131m\u0131n\u0131n da engellenmesi, k\u0131nanan di\u011fer unsurlar aras\u0131nda yer ald\u0131.<\/p>\n<p>B\u00fct\u00fcn devletleri, ter\u00f6r eylemlerini icra eden, organize eden ve destekleyen DAE\u015e ve el-Nusra Cephesi&#8217;ni de kapsayacak \u015fekilde, el-Kaide ile ba\u011flant\u0131l\u0131 t\u00fcm \u015fah\u0131s, grup, giri\u015fim ve olu\u015fumlar\u0131 bulma ve adalete teslim etme \u00e7abalar\u0131na y\u00f6nelik i\u015f birli\u011fine te\u015fvik eden kararda, ter\u00f6r sald\u0131r\u0131lar\u0131n\u0131n k\u0131\u015fk\u0131rt\u0131lmas\u0131na kar\u015f\u0131 koyma ve e\u011fitim kurumlar\u0131yla k\u00fclt\u00fcrel ve dini kurumlar\u0131n, ter\u00f6ristler ve destek\u00e7ileri taraf\u0131ndan y\u0131k\u0131lmas\u0131na engel olmayla ilgili, uluslararas\u0131 kanun gere\u011fince gerekli ve uygun tedbirlerin al\u0131nmas\u0131 noktas\u0131nda b\u00fct\u00fcn devletlere y\u00f6nelik \u00e7a\u011fr\u0131 da yap\u0131ld\u0131.<\/p>\n<p>Me\u015fru m\u00fcdafaa hakk\u0131<br \/>\nBu arada, bir devletin \u00fclkesel b\u00fct\u00fcnl\u00fc\u011f\u00fcne ve siyasal ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131na kar\u015f\u0131 kuvvet kullanmak, Birle\u015fmi\u015f Milletler Antla\u015fmas\u0131&#8217;nca yasaklanan durumlar aras\u0131nda yer al\u0131yor ancak bunun iki istisnas\u0131 bulunuyor. Bunlardan biri BM G\u00fcvenlik Konseyinin yetkilendirmesi, di\u011feri ise me\u015fru m\u00fcdafaa hali.<\/p>\n<p>Me\u015fru m\u00fcdafaa hakk\u0131n\u0131n kullan\u0131labilmesi i\u00e7in silahl\u0131 sald\u0131r\u0131n\u0131n varl\u0131\u011f\u0131 gerekiyor ancak bu sald\u0131r\u0131n\u0131n herhangi bir devletten kaynaklanmas\u0131 \u015fart\u0131 aranm\u0131yor. Devletlere tek ba\u015flar\u0131na me\u015fru m\u00fcdafaa haklar\u0131n\u0131 kullanmalar\u0131n\u0131n yan\u0131 s\u0131ra ba\u015fka devletleri de yard\u0131ma \u00e7a\u011f\u0131rarak birlikte bu haklar\u0131n\u0131 kullanma hakk\u0131 tan\u0131n\u0131yor.<\/p>\n<p>Bu kapsamda ter\u00f6r \u00f6rg\u00fct\u00fc DAE\u015e taraf\u0131ndan gerek Suriye&#8217;nin kuzeyinden yurda yap\u0131lan at\u0131\u015flar gerekse ter\u00f6r sald\u0131r\u0131lar\u0131, T\u00fcrkiye&#8217;yi bu konuda hakl\u0131 duruma getiriyor. Uluslararas\u0131 anla\u015fmalar da T\u00fcrkiye&#8217;nin bu konudaki hakl\u0131l\u0131\u011f\u0131n\u0131 ortaya koyuyor.<\/p>\n<p>Birle\u015fmi\u015f Milletler Antla\u015fmas\u0131&#8217;n\u0131n 7. b\u00f6l\u00fcm\u00fc, bar\u0131\u015f\u0131n tehdidi, bozulmas\u0131 ve sald\u0131r\u0131 eylemi durumunda \u00fcye \u00fclkelerin alacaklar\u0131 \u00f6nlemleri d\u00fczenliyor. Anla\u015fman\u0131n 51. maddesine g\u00f6re, BM \u00fcyelerinden birinin silahl\u0131 bir sald\u0131r\u0131ya hedef olmas\u0131 halinde G\u00fcvenlik Konseyi, uluslararas\u0131 bar\u0131\u015f ve g\u00fcvenli\u011fin korunmas\u0131 i\u00e7in gerekli \u00f6nlemleri al\u0131ncaya dek, sald\u0131r\u0131ya u\u011frayan \u00fcyenin me\u015fru savunma hakk\u0131 bulunuyor ve kanunun hi\u00e7bir maddesi buna halel getiremiyor.<\/p>\n<p>Yabanc\u0131 ter\u00f6rist sava\u015f\u00e7\u0131larla m\u00fccadele<br \/>\nBM G\u00fcvenlik Konseyinin dikkati \u00e7ekti\u011fi bir di\u011fer konuyu ise yabanc\u0131 ter\u00f6rist sava\u015f\u00e7\u0131 tehdidi olu\u015fturuyor.<\/p>\n<p>Konsey, bununla ilgili 2014&#8217;te harekete ge\u00e7mi\u015f, bu kapsamda \u00e7e\u015fitli kararlar al\u0131nm\u0131\u015ft\u0131. Irak ve Suriye&#8217;deki DEA\u015e unsurlar\u0131 i\u00e7erisinde 100&#8217;\u00fc a\u015fk\u0131n \u00fclkeden 25 bin civar\u0131nda yabanc\u0131 ter\u00f6rist sava\u015f\u00e7\u0131n\u0131n bulundu\u011fu, konsey belgelerinde de yer alm\u0131\u015ft\u0131. Bu sorunun \u00e7\u00f6z\u00fcm\u00fcnde \u00f6zellikle kaynak \u00fclkelerin yabanc\u0131 ter\u00f6rist sava\u015f\u00e7\u0131lar\u0131 \u00fclkelerinde tespit ederek \u00fclke d\u0131\u015f\u0131na \u00e7\u0131k\u0131\u015flar\u0131na izin vermemelerinin \u00f6nemli \u00e7ok defa vurgulanm\u0131\u015ft\u0131.<\/p>\n<p>T\u00fcrkiye de bu konuda \u00f6nemli tedbirler alm\u0131\u015ft\u0131. Bu kapsamda 2011&#8217;den 2016&#8217;n\u0131n \u015fubat ay\u0131na kadar 37 bini a\u015fk\u0131n ki\u015fiye yurda giri\u015f yasa\u011f\u0131 konulmu\u015f, ter\u00f6r \u00f6rg\u00fctleriyle ili\u015fkisi oldu\u011fundan \u015f\u00fcphelenilen ve yasa d\u0131\u015f\u0131 yollardan yurda giri\u015f yapan 3 binden fazla yabanc\u0131 s\u0131n\u0131r d\u0131\u015f\u0131 edilmi\u015fti.<\/p>\n<p>\u00c7e\u015fitli havaliman\u0131 ve otob\u00fcs terminallerinde kurulan risk analiz gruplar\u0131nca da 7 bin 500 yabanc\u0131 kontrol edilmi\u015fti.
