The most belligerent issue after government establishment following a 6 months blockade appears to be the adoption of Special Court establishment, a Washington and Brussels requirement.
US officials have quite openly said that its formation is inevitable and that there are two possibilities: that the Special Tribunal formation is decided in Kosovo by its lawmakers and laws or in the contrary the court would be established by the Security Council of the United Nations in New York.
“Affirmative voting for the creation of the Special Court in the Kosovo Assembly, would avoid the desire of some not very sympathetic countries towards Kosovo statehood, that it is created by the Security Council,” says a RTK source in Washington, adding that they are awaiting its inclusion in Assembly agenda and lawmakers’ vote in its favor. According to RTK source, the US government also has made it clear to Kosovo authorities that if not adopted by Kosovo, ‘it would not block an initiative, either by Russia or any other state that proposes the creation of the Court by the Security Council.’
United States of America as a guarantor and promoter of Kosovo independence were very active through public statements and other forms of communications in their demand for the establishment of special chambers of the court by Kosovo assembly.
There are fears that the goal of countries like Russia, several Latin American countries and Islamic ones is to restore the state of Kosovo in the initial position of after-war period and return into operation and functionality the UNMIK resolution 1244.
