The European Union (EU) said that it is aware of Sunday's vote, which resulted in the constitution of the Assembly of Kosovo and the formation of the new Government, but added that it is up to the highest court instead to give an assessment about the constitutionality of the establishment of these institutions. "We are aware of Sunday's votes, as well as the decisions on the constitution of the Assembly and the formation of the Government. We are also aware of the request submitted to the Constitutional Court regarding the constitutionality of these decisions. It is up to the Constitutional Court to express itself on the submitted request", said a spokesperson of the European Commission for Radio Free Europe. The spokesperson also emphasized that Kosovo needs "fully consolidated institutions to advance reforms and advance on the path of integration into the EU, including in within the framework of the Growth Plan for the Western Balkans". In the constitutive session held on Sunday, September 13, the vice-presidents of the Assembly were elected from among the Democratic League of Kosovo, from the Serbian community and the non-Serb minorities, as the president Albulena Haxhiu declared the legislative body constituted without the election of the vice-president from the ranks of the Democratic Party of Kosovo – the second political power in the country. A spokesman for the European Commission also confirmed that the EU is also aware of the request submitted to the Constitutional Court regarding the constitutionality of these decisions, assessing that it is up to this institution to express itself on the request submitted. Two MPs of this party, Arian Tahiri and Përparim Gruda, together with lawyer Faton Fetahu, submitted the complaint on behalf of the party on Monday morning. Speaking to the media after submitting the complaint, Tahiri said that "it is important to impose a temporary measure first, so as not to cause damage and more serious situations in a legal and institutional sense". According to them, the Vetëvendosje Movement in power violated the constitutional deadline of 30 days for the constitution of the Assembly, as well as the procedure for calling the session every 48 hours until its constitution. According to a last year's verdict of the Constitutional Court, the Assembly must be constituted within 30 days from the certification of the results.
