People’s Advocate, Naim Qelaj, has said that the country is functioning for the second year without complete institutions, as a result of repeated elections.
According to him, the non-establishment of institutions is infringing on human rights and creating uncertainty among citizens about further developments in the country.
“It is the second year that Kosovo continues to function without complete institutions, as a result of the elections that are taking place in Kosovo repeatedly. The lack of establishment of institutions violates and affects human rights very badly, primarily due to the stagnation of legislative initiatives, the change of laws and the issuance of new laws that directly affect the lives of citizens, their well-being and the increase of the standard. It also affects the work of other institutions, which, in the absence of supervisory authorities, remain at a very low level of engagement in their daily work, but also in projects that do not reach ended and they do not manage to start new ones. And this has naturally made the citizens of Kosovo face a situation of uncertainty, or unpredictability, of what will happen next”, Qelaj told KosovaPress.
He expects the result of the last elections to be finalized with the creation of institutions, warning that the continuation of political and institutional crises would deepen the damage to the country.
According to Furthermore, a number of institutions operate with extended mandates, including the institution of the People’s Advocate.
“I consider that the result of the last elections will be finalized with the creation of institutions and will not continue with other institutional political crises, because we are also in a difficult situation where a large number of institutions have extended mandates, including the Ombudsman. So, I am in the position of the People’s Advocate with an extended mandate, according to the law until in the election of the new Advocate, otherwise my five-year mandate has already ended in October of last year. The damage that is being caused to Kosovo by not creating institutions is extraordinary,” he said.
The People’s Advocate emphasizes that the institutional crisis has brought about budgetary restrictions, stagnation in legislative initiatives, infrastructure projects and justice reforms. He says that one of the main principles of justice reform should be respect for the separation of powers.
He has also raised concerns about the tendencies of interference in the justice system, calling for politics and the executive to stay away from influencing the judiciary and the prosecutor’s office.
“I think that there have been actions that show a tendency to interfere in justice. I start from the reactions of institutional leaders to specific names. I mention them as undesirable for leading positions within the prosecutorial and judicial system, up to the calls and trends that announce competitions, or take concrete actions. The judicial system, the Judicial Council and the Prosecutorial Council, are independent authorities, which must make their decisions based on the needs and plans they make, and not on the basis of political agendas. Therefore, my call in this case is that politics and the executive should stay away from me interventions in the justice system, but always supporting and coordinating and cooperating in the interest of a real reform”, said Qelaj.
The last elections in Kosovo were held on June 7 of this year, where the political entity Lévizja Vetëvendosje emerged as the winner.
Certification of the results by the Central Election Commission has not yet been done, after complaints by several candidates for deputies to the Supreme Court of Kosovo. Kosovo.
The head of the LVV, Albin Kurti, has stated to the media that after the certification of the results, he will communicate with the political parties to reach an agreement on the formation of institutions and the election of the president of Kosovo.
The previous elections were held on December 28 and February 9, in which the LVV was also the winner because no agreement was reached in the December elections for the election of the president.
