Hasani: Haxhiu as the President’s deputy cannot mandate the new prime minister

Professor of International Law, Enver Hasani, has stated that according to the last judgment of the Constitutional Court [25.03.2026], the acting president, Albulena Haxhiu, does not have the authority to appoint Albin Kurti, or anyone else as prime minister.

In the Rubicon show on Klan Kosova, Hasani said that this interpretation stems directly from the act of the Constitution and is not an opinion his personal.

“According to the verdict of the Constitutional Court, Albulena Haxhiu cannot decree Albin Kurti as prime minister. I am not saying this, the court said. Politics can decide otherwise, as it has decided in some cases”, he declared.

According to Hasan, the power to decree the mandate for the formation of the government belongs to the president of the country, so first the president must be elected and then proceed with the formation of the to the government.

“The president must start by decreeing the new mandate for prime minister. According to this judgment, the acting president cannot. First the constitution of the Assembly, the president and then the government. Otherwise, it is a constitutional violation”, stressed Hasani.

He recalled that in the past acting presidents have decreed proxies for prime minister, mentioning also the case of Vjosa Osmani, who had decreed Kurt. However, according to him, the verdict of March 25, 2026 has already set a new constitutional standard.

“It is said that the president must decree it, so the decree must be decided after that. First, the constitution of the assembly, the president and then the government. Otherwise, it is a constitutional violation. If no one takes this violation to court, that case is closed,” said Hasani.
