On February 27 of this year, the Basic Court in Pristina said that the three suspects E.A., A.K. and A.L. were released from the detention measure because the Prosecution did not present minimal evidence to support the suspicion of the criminal offense.

However, this decision was canceled by the Special Department of the Court of Appeal, returning the criminal case to reinstatement.

This court remembers how the Basic Court in Pristina – Special Department, with the ruling dated 27.02.2026, rejected the request of the Special Prosecution of the Republic of Kosovo for the appointment of the measure of detention against the defendants E.A., A.K. and A.L., suspected of the criminal offense “Money Laundering”, and immediately released the same to defend themselves in freedom from 27.02.2026.

“The Appeals Panel has found that the appealed decision is involved in an essential violation of the provisions of the criminal procedure, a violation that is related to the incorrect implementation of the material provision, because the court of first instance, in the case of the rejection of the request of the Special Prosecutor’s Office of the Republic of Kosovo for the determination of the measure of detention, did not give sufficient reasons as to how it came to the conclusion regarding the lack of reasonable suspicion. Also, the reasoning of the appealed decision turns out to be generalized, unclear and in some parts even contradictory”, says the notice of the Court of Appeal.

The panel of the Court of Appeal has assessed that “the court of first instance did not give reasons sufficient on the basis of which it has concluded that there is no reasonable doubt that the defendants have committed the criminal offense of ‘Money Laundering’ and there is no basis for determining the measure of detention against them, because it has not made a full assessment of the materials found in the case files in relation to the elements of the criminal offense for which they are suspected, therefore the Court of Appeal has annulled the appealed decision because the same cannot to remain legally as such”.

The Basic Court in Pristina, on February 27, said that the three suspects E.A., A.K. and A.L. were released because the Prosecution did not present minimal evidence to support the suspicion of the criminal offense.

“The Judge of the Preliminary Procedure through the Decision has rejected the request of the Special Prosecution of the Republic of Kosovo, while the defendants have been released immediately, from the moment of delivery of this decision. The Court found that in this case the essential condition of Article 184 paragraph 1 point 1.1 of the Criminal Procedure Code is not fulfilled, respectively The Prosecution failed to prove that there is a well-founded suspicion that the defendants E.A., A.K. and A.L. have committed the criminal offense they are suspected of, since according to the Court no evidence, no matter how superficial, was mentioned in which the Prosecution supports its claim regarding the well-founded suspicion. evidence, the court is obliged to apply article 163 par.3 of the KPPRK and release the defendants E.A., A.K. and A.L.

The Special Prosecutor’s Office announced on February 24 that three suspects, E.A, A.K. and A.L., were detained, who were caught with 1 million euros hidden under a van at the border crossing point in Merdar, while they were entering from Serbia to Kosovo.

“The suspects A.L., A.K., and E.A. were detained at the border crossing point in Merdare, after carried out by the Police and Customs of Kosovo, a large amount of money was found and seized in a vehicle driven by one of them. According to initial estimates, the amount is suspected to be one million euros. The Special Prosecutor’s Office of the Republic of Kosovo, in cooperation with the Police of Kosovo, is taking all the necessary actions, in accordance with the legal procedures in force, for the full investigation of the case,” said the announcement of the Special Prosecutor’s Office.
