The Supreme Court rejects the request for termination of detention in the case of property fraud in Veternik

The Supreme Court of Kosovo has decided on the request for termination of detention in the case of suspicions of fraud and forgery of documents with properties in the Veternik neighborhood.

This court has decided to reject as unfounded the request for protection of legality presented by the defense of the suspect M.M., against the rulings of the Basic Court in Pristina and the Court of Appeal of Kosovo, reports Klankosova.tv

Basic Court in Pristina with the decision of March 25, the defendants M.M. and Zh.J. had continued the measure of detention for a duration of two (2) months.

In the appeal procedure, the Appeal had also rejected as unfounded the complaints of the defendants’ defenders and had confirmed the decision of the first instance. and the case be returned to reinstatement, or be changed by releasing the defendant from detention, respectively by replacing the detention with house arrest and other restrictive measures.”

But, after reviewing the case documents and the allegations presented in the request, the Supreme Court assessed that the request is unfounded, reports Klankosova.tv

According to the Court’s assessment, there is a well-founded suspicion that the defendant may have committed criminal offenses for which investigations are underway.

“The Supreme Court assesses that there is a legal basis for the continuation of detention due to the risk of escape; influence on witnesses and co-defendants, destruction of evidence or coordination of statements in order to avoid criminal responsibility, as well as the risk that the defendant, if released, will repeat criminal offenses of the same or similar nature.

The defendant, together with persons of others, is suspected of falsifying property documents and attempting to register them at the Cadastre Office in the Municipality of Pristina for the plot with number P-…, with an area of 5976 m², which is located in Veternik.

The Supreme Court found that the courts of lower instances have given sufficient and well-founded reasoning regarding the continuation of the detention and that in this particular case the provisions of the criminal procedure have not been violated.”
