D+ states that the tender file with number 622-26-5203-2-1-1 foresees the engagement of consultants for reviewing applications for legalization, verifying documentation, preparing reports and performing daily administrative tasks.

According to the organization, these are functions that are usually performed by municipal officials and do not require external expertise. Likewise, the duration of the contracts of 36 months, according to D+, proves that it is a matter of permanent needs of the institution and not of temporary engagements.

Democracy Plus recalls that article 56 of the Regulation on Public Procurement allows the use of Agreements for Special Services only when the institution needs expertise that cannot be provided by internal staff.

For this reason, D+ has appealed to the Municipality of Prizren to cancel the tender and, if these positions are needed on an ongoing basis, to fill them through regular employment procedures.

The organization has also called on the responsible institutions to review this procedure and ensure the implementation of public procurement legislation.
