The Basic Court in Pristina has found the acting Minister of Internal Affairs, Xhelal Sveçla, guilty for throwing tear gas in the Assembly on March 21, 2018.
Sveçla was found guilty of the criminal offense of “Using a weapon or dangerous tool”. received a rejection verdict due to the statute of limitations.
The chairman of the trial panel, Sabit Sadikaj, said that Sveçla was found guilty after using a tear gas canister in the Assembly hall, making it impossible to continue the session.
“He is guilty because on August 21, 2018 in Pristina, in the Assembly hall, during the session, he used the gas canister, made it impossible to hold the session. He activated it to be thrown inside, with which the deputies of Kosovo were forced to leave the hall”, said Sadikaj.
He announced that the court on Wednesday only announced the verdict of guilt, while the decision on the punishment will be taken on September 8, from 09:00, after the presentation of mitigating and aggravating circumstances.
Sveçla was not present at session, while he was represented by his lawyer, Laur Prenaj.
In this case Fitore Pacolli-Dalipi, Salih Zyba and Drita Millaku are also accused, while the procedure against Sveçla was separated from that against the other accused.
According to the amended indictment, Sveçla on March 21, 2018 had activated and thrown the tear gas canister with CS chemical agent in the Assembly hall, causing the interruption of the session.
The prosecutor’s office has given up the criminal prosecution for the offense of “Obstructing an official in the performance of official duties”, due to the statute of limitations, while the rest of the indictment has remained unchanged.
