The Supreme Court of Kosovo, in the criminal case against the defendants Edmir Ahmagjokaj, Aurel Kaziu, and Ardit Laska, for the criminal offense of money laundering, has made a decision regarding the appeals presented by the defendants’ defenders.

Deciding on the appeals against the ruling of the Court of Appeal of Kosovo, PN.1.S.nr.68/2026 dated March 18, 2026, at the collegium session held on March 30, 2026, the Supreme Court has decided to approve the appeals of the defendants’ defenders, cancel the decision of the Court of Appeal and return the case to reinstatement, in the same court, reports klankosova.tv

The Basic Court in Pristina, Special Department, with the decision of March 9, 2026, had rejected the request of the Special Prosecution to assign detention to the defendants.

However, the Court of Appeal of Kosovo, on March 18, 2026, had approved the appeal of the Prosecution and changed this decision by assigning the defendants the measure of detention of 30 days.

Against this decision, the defenders of the defendants filed appeals, contesting the legality and validity of the detention.

The Supreme Court assessed that the appeals are well-founded and concluded that the decision of the Court of The appeal contains essential violations of the provisions of the criminal procedure.

According to the assessment of the Supreme Court, the second instance did not make a clear connection between the evidence and the actions of the defendants.

The Supreme Court emphasizes that the existence of reasonable suspicion is a fundamental condition for assigning detention, in accordance with the practice of the European Court of Human Rights.
