The tender was approved, announced and canceled due to lack of money, without concrete answers

Documents obtained by the Front Online portal highlight a series of decisions that raise serious questions about financial planning and the way the procurement activity was initiated. The tender with number 622-26-4204-2-1-1, for “Physical Security of KPSH facilities”, was announced as an open procedure and public framework contract. The notice for the contract was published on the electronic procurement platform on June 4, 2026. However, the road to the announcement of the tender had passed through two decisions of the Mayor of the Municipality, Shaqir Totaj. On March 26, 2026, Totaj had approved the request of the Directorate of Health for the physical security of primary care facilities. The decision determined that the contract would be for three years and that the project would be realized from the planned budget code of the Directorate of Health. Then, on May 21, 2026, the president issued another decision on the same issue. Even there it was repeated that the contract would be for three years and that the financing would be done from the planned budget of the Directorate. However, with the same decision, the preliminary decision of March 26 was annulled. This means that, before the tender was announced, the Municipality had gone through two official acts for the same project and in both had confirmed the existence of the budget basis. On August 14, 2026, the Municipality of Prizren published the notice for the cancellation of the activity. According to the document, the tender was canceled before the opening of bids. What makes the case even more problematic is the financial rationale. In the cancellation document, the Directorate itself requests that the procedure be terminated due to the lack of budget funds in the goods and services category, emphasizing that the funds have been received by the executor. According to the Municipality, due to the value of the project and the “trend of receiving budget funds by the executor”, the realization of the contract would be impossible even for the following years. This creates a clear contradiction in the institutional documentation. In March and May, the Municipality declares that the project is carried out according to the planned budget code. In June, he announces the tender.

In August, he cancels the procedure on the grounds that the means for its implementation are missing. In fact, in the cancellation form, the Municipality justifies the interruption with “events and/or objective and demonstrable reasons” beyond the control of the contracting authority and unforeseeable at the time when the procurement activity was initiated.

For this issue, Front Online has sent questions to the Municipality of Prizren. In this case, the answer was given directly by the mayor of the Municipality of Prizren, Shaqir Totaj. However, Totaj has not specifically answered the questions of the portal and has not provided clarifications about the contradiction between the decisions on financing the project and the subsequent cancellation due to lack of funds. He was satisfied with just one short sentence: “I believe that he knows how to act in such cases in order to manage as best as possible”, wrote Totaj in his answer.
